WHITE PINE BLVD., NEW ALBANY, IN 47150 812-949-3064 RULES AND REGULATIONS A. DUE DATE
1. Total monthly rental is due and payable in advance on the day
of the month that home is placed on lot.
Rent not paid by the 5th day of the monthly due date, an additional
$5.00 charge for each day until rent is paid.
2. Each resident must be registered with the office.
Each vehicle must be registered with the office.
3. Base lot rental covers two persons. An additional $25 per person, per month will be charged for
each add'l person over two people. B. SECURITY DEPOSIT
1. A security deposit of $200 is required, in addition to the
first month’s rent, before moving in.
2. The security deposit will be returned within 30 days after
termination of the Rental Agreement or surrender and acceptance of the
space, whichever occurs last, provided:
a) All rent due has been paid in full.
b) Tenant gives thirty (30) days prior written notice of departure.
c) No damage has been done other than reasonable wear, and the
space is clean.
d) Tenant is not in default under this Agreement. In the event that actual cause exists for
retaining any portion of the security deposit, Management will provide
Tenant with a written statement listing the exact reasons for such
detention.
e) Applicant, at time of application, must furnish name of
insurance company and policy number.
f) There will be a $20.00 charge for any check returned due to
insufficient funds. C. HOME AND LOT
RESPONSIBILITY
1. All homes must be owner occupied for residential use only.
Business or commercial activity is prohibited. Renting or subletting of homes in the park is not permitted.
2. Set-up of manufactured home shall be responsibility of the
Tenant. Each home must be
anchored to the ground as part of the set-up.
3. Exterior maintenance of the water line from the riser of the
home is the responsibility of the tenant.
Water lines must be leak free and wrapped full length with an
operating heat tape. Tenant
will not waste water nor allow hoses or lawn sprinklers to run unattended. Management may inspect interior of tenant's home for water
leaks and improperly operating fixtures, if management thinks necessary.
Immediate repair or replacement of such leaks or fixtures shall be
the responsibility of the Tenant. Water
saving devices and regulators shall be installed as required by
management.
4. Each manufactured home must be completely skirted within 30
days of occupancy. The
management must be consulted about building codes, state laws and
regulations before installation. The
skirting must be of a type of material and size approved in advance by the
management.
5. The management will provide bulb replacement for security
light, located on each lot.
6. Fences are not permitted.
7. Trash and garbage must be stored and disposed of in a manner
approved by the management. All
trashcans must be picked up the day of garbage collection day.
8. No outdoor atennas are permitted.
9. Tenants are required to keep the exterior of their homes,
patios, carports, and lots in a neat, clean, orderly fashion. If lots are neglected, management may correct the condition
and charge for this service will be added to the following month's rent.
10. Only standard patio furniture and barbecue equipment in good
conditions may be kept outside the home.
All other articles must be contained in a management-approved
storage shed.
11. Swingsets, trampolines or pools are not permitted. Basketball
goals must be on driveways, not by streets.
12. Sea doo's, jet skis, boats or any other watercrafts are not
permitted.
13. Motor homes, travel trailers or campers are not permitted.
14. Automobiles on jacks, with wheels off are not permitted.
15. Oil leaking cars are not permitted.
16. Salt on concrete driveways is not permitted.
17. The sewer line from the home to the main line is the tenant's
responsibility and everything above the ground and inside of the home is
the tenant's responsibility.
18. Outside clotheslines are not permitted.
19. Only inside window "For Sale" signs are permitted.
20. Awnings, sheds, carports and steps must be located in an
area, and be of a type of material and size, approved in advance by the
management. Sheds must be
wood, painted to match home, shingle roof and no larger than 8’x 10’.
21. Wood or gas fireplaces are not allowed in the community.
22. Landscaping should be completed within 60 days.
Trees, shrubs, landscaping, patios, driveways and other physical
improvements if a permanent type must be located in an area, and be of a
type of material and size approved in advance by the management and shall
become the property of the Development when planted and/or installed. D. GENERAL
RESPONSIBILITIES
1. Grass must be cut and maintained by the tenant to meet
management standard, or management will take care of it and charge the
tenant for the services.
2. Any pet, which at full growth weighing more than 30 pounds,
is prohibited. Smaller pets
are permitted only with prior written permission of the management. If permitted, pets shall be housed inside the manufactured
homes and when outside must be accompanied by a person and kept on a
leash. Tenant or guest is
required to clean up after pet, even in own tenant’s yard.
Allowing pet to use another tenants yard is prohibited.
Local authorities shall remove any animal that becomes a nuisance.
Tenants shall be responsible for any fines levied because of their
pets.
3. Disturbing the peace, profanity, indecency, and drunkenness
are prohibited throughout the development.
4. Tenants will be held responsible for the conduct of, and for
any damages caused by, their children, pets and guests.
5. Door-to-door solicitation is prohibited.
6. Motorcycles, motorbikes or dirt bikes may not be ridden in
the development except to enter and depart the site.
7. Street parking is allowed only for pick-up and delivery
vehicles. Three-hour maximum
street parking in a 24-hour period. Parking
in unpaved areas or on sidewalks is prohibited.
8. Posted traffic signs and any other posted notices are to be
considered a fixed part of these Rules and Regulations.
9. Heavy-duty trucks, tractors or inoperable vehicles are
prohibited. The largest truck
is a 3/4 pick-up.
10. Tenants shall comply with all laws, ordinances, and
governmental regulations applicable to the home and the development.
11. Operators of motor vehicles must have a valid driver’s
license and all motor vehicles must be registered with the management.
12. The major repair of vehicles is prohibited.
13. The discharge of firearms is prohibited.
14. The dumping of garbage, trash, gasoline and oil is
prohibited.
15. The burning of trash is prohibited.
16. The discharge of all fireworks is prohibited.
17. Children under the age of 17 must be in their own homes by
10:00 PM unless accompanied by a parent.
Small children must not be left unattended at any time.
18. Exterior of home must be maintained to meet management
standards.
19. The owner of the manufactured home is responsible for the
water supply line located under each home and extending upward into the
inside of your home.
20. To assure water line from freezing, a FROST TEX electrical
heating strip tape must be wrapped two ft. below ground level at source of
water supply and continuing into the inside of you home.
21. In addition to the heating strip tape there is sufficient
room to stuff insulation around water supply line 18" to 24"
below ground level at water supply source. THIS IS A MUST.
22. To protect your hot water heater, etc. in you home, if water
supply is cut off for any reason, a CHECK VALVE, must be installed in your
water supply line under your home. If
the home does not come with a CUT OFF VALVE,
you will have to make arrangements to have this installed. F. TERMINATION
1. The rental agreement may be terminated upon lawful written
notice to Tenant by management for the following reasons:
a) Non-payment of rent.
b) Failure of the tenant to comply with local ordinances and state
laws and regulations relating to manufactured homes.
c) Conduct of the tenant, on the premises, which constitutes an
annoyance to other tenants or interference with management.
d) Failure of the tenant to comply with rules and regulations
established by management if accordance with local ordinances, state laws
and regulations, or emergency situations.
e) Condemnation or change of use.
f) The making or causing to be made, with knowledge, of false or
misleading statement on an application for tenancy.
g) Application will not be approved until satisfactory credit
report is obtained.
2. Tenant may
terminate the rental agreement as follows:
a) At least thirty (30) days prior written notice to management
with the removal of the mobile home within the 30 day period, or
b) By a sale of Tenant's manufactured home and acceptance by
management of the purchaser as tenant of the development.
3. In case of eviction, abandonment or repossession, management
may collect from tenant reasonable attorney's fees, court costs, the cost
of moving the home out of the development and other related costs incurred
by management. G. REQUIREMENTS FOR
NEW HOMES
1. Vinyl siding
2. Shingle roof
3. Gutters and downspouts
4. Shutters on windows
5. Vinyl skirting
6. On single homes, the window-facing street has to have a bay,
bow or double window.
7. Homes must be landscaped in a reasonable period of time H. LOT RENT INCLUDES
